Gautam Adani's Mundra SEZ under Jairam Ramesh's Radar.

The environment ministry today issued a show-cause notice to Mundra Port and Special Economic Zone Limited, a private port and special economic zone being developed on the west coast of the country, for alleged violation of the provisions of the Coastal Regulation Zone (CRZ) Notification.

Acting on a complaint of NGO Machimar Adhikar Sangharsh Sangathan, the ministry asked the port to reply in 15 days why the clearance accorded to the West port and North port and the environmental clearance accorded to the township project by Gujarat State Environment Impact Assessment Authority (SEIAA) should not be cancelled.

Gautam Adani, the Gujarat based industrialist is considered to be close to Gujarat Chief Minister Narendra Modi and has flouted envir0nmental rules to develop Mundra .

Issue has been noticed to Mundra SEZ on 15 grounds.

Sohrabuddin case: Amit Shah gets furthur respite.

Former MoS home, Gujarat Amit Shah has got a further respite from the apex court. In a crucial hearing today where the CBI was keeping its fingers crossed about Amit Shah's bail being cancelled, the court has adjourned the matter. The matter is now scheduled for hearing on january 27 2011.
This is like a slap on the CBI's face. The sohrabuddin fake encounter case stands weakened.
Today's supreme court development means Amit Shah cannot enter Gujarat but is literally a free bird for a furthur period.
CBI is in for a lot of criticism for the manner in which it is handling the case.

Abhay Chudasama's father dead.

Suspended cop Abhay Chudasama’s father Devsang Chudasama, passed away today early morning (Dec 12,2010)at his native village Ratanpur in Vallabhipur taluka in Bhavnagar district. He was 84 years old.

Popularly known as Devsangdada, Abhay Chudasama’s father had devoted his life to educate underprivileged village children.

Abhay Chudasama’s arrest in the Sohrabuddin fake encounter case had shocked him and he had taken ill subsequently.

Abhay Chudasam who underwent a hip replacement surgery on December 9 is in a city hospital and could not travel and attend the last rites of his father. However, just before the surgery, Chudasama through a special permission given by a local court travelled to Bhavnagar on November 24 with police escort and visited his father in the Wockhardt hospital. After visiting his father, Abhay Chudasama who had reported back to Nadiad jail as per the court order was immediately admitted to a city based ortho hospital in Ahmedabad where he underwent a major seven hour surgery.

Abhay ‘s father headed the Bhalsangh Seva Mandal that ran a residential school in Ratanpur.

Delusions of Power and Grandeur.

Every journalist worth her salt or sometimes not worth anything also suffers from delusions of grandeur and power.
Who makes journos powerful?
or gives them this illusion of being powerful and being in control.
We meet and interact with a good number of individuals. Yes, we do need to humour our sources but does that "humouring" up mean we sell our souls?
We will tackle this issue in next few days...
Credibility is the biggest asset of those who manage this blog. Nope, accusations dont hurt us because we are clear. We are not ideologically bankrupt and do not make any claims of being "neutral". It is simply that we believe that no development, growth or governance can be justified if it is not seconded by a sound and equitably just social system. We like to believe and rigidly believe that economic growth has a hollow connotation if our moral values show a deficit.
Any economic growth along with a moral deficit as a partner is soul wrenching and we do not subscribe to this module.
In the coming days, we plan to take this debate further.

A scandalous collusion involving politicians and the media has exposed India's ethical deficit

  • Imagine, if it's possible, that Jeremy Paxman and Matthew Parris are recorded on tape advising a corporate lobbyist how to get her favoured MP into the coalition cabinet. Then imagine that this MP is accused of defrauding the national exchequer of billions of pounds. This is the scandal that unfolded in India last week – more disturbing and revealing for the Indian public than anything from WikiLeaks.

    In addition to this story, in one of the audio recordings intercepted by India's income tax department (and now widely available on the internet), Vir Sanghvi, a leading columnist and TV host, is heard offering his services to Niira Radia, a lobbyist for two of India's biggest corporate houses, the Tatas and Reliance Industries.

    "What kind of story do you want?" Sanghvi asks Radia, and goes on to offer a "scripted" and "rehearsed" television interview to her client, Mukesh Ambani, India's richest man. Another tape has Prabhu Chawla, an editor with India Today – India's biggest-circulation news magazine in English – explaining to Radia how Ambani might win his supreme court battle against his brother. "Everything is fixed nowadays," he hints darkly. Barkha Dutt – who hosts a popular TV show called We, the People – can also be heard offering to relay messages from Radia to politicians whom Radia wants to influence in the process of forming a cabinet.

    Radia's candidate – A Raja – did indeed go on to become the telecommunications minister. He now stands accused of depriving the national exchequer of $39bn by selling mobile phone "2G spectrum" bandwidth cheaply to, among other telecom companies, Tata – represented by Radia. Under pressure from opposition parties and the supreme court, Raja resigned last month. The journalists caught on tape have preferred to brazen it out, insisting that they were only squeezing a likely source for information.

    At first it seemed they might get away with it when such high-circulation mainstream newspapers as the Times of India and the Hindustan Times refused to cover the scandal. But public anger, amplified by the internet, may now be making the censorship unsustainable.

    Yesterday Dutt appeared on her own TV channel, claiming she was guilty of nothing more than an "error of judgment". Her prickly defence – that only a naive journalist would see something newsworthy in the oversized influence of corporate lobbyists on political processes – pointed to a deeper rot in the New India beloved of business and political elites. As Sonia Gandhi, the Congress party leader, put it: the country's economy may "increasingly be dynamic, but our moral universe seems to be shrinking ... The principles on which Independent India was founded, for which a generation of great leaders fought and sacrificed their all, are in danger of being negated."

    Indeed, for influential Indians the model of a "great" leader today is provided by Narendra Modi, the business-friendly Hindu nationalist chief minister of Gujarat who is accused of complicity in the murder of more than 2,000 Muslims in 2002. Ratan Tata, one of the most respectable names in Indian business, hails Modi as a "dynamic leader".

    It is too easy, however, to focus on the moral obtuseness of a few journalists and businessmen. A broader consensus exists within the middle class beneficiaries of India's economy, a wider culture of deference to powerful and wealthy people, and intolerance and meanness towards the poor and defenceless, and their few articulate defenders. Mainstream journalists too have succumbed to this political pathology. What the tapes reveal most vividly is not spectacular corruption – not exactly news – so much as why the supposed watchdogs of democracy have assumed the militant aggressiveness and vanity of the very privileged in a wretchedly poor country.

    Ratan Tata, whose conversations with Radia were also recorded, now complains that India is turning into a "banana republic". But Tata's own praise of Modi signified the ethical deficit among India's rich and powerful. Certainly, Sanghvi sounded like a Latin American oligarchist when, criticising the US decision to deny Modi a visa, he argued: "Modi may be a mass murderer. But he is our mass murderer." Claiming to speak for the "educated Indian middle class", Sanghvi asserted that "we are entirely justified in being angered" by Arundhati Roy's recent remarks on India's military occupation of Kashmir.

    Marvelling about a "concept of Indian unity" that endorses extrajudicial execution and torture, the social psychologist Ashis Nandy recently wondered if there was "a large enough section of India's much-vaunted middle class fully sensitive to the demands of democracy". Or could it be that, far from upholding progressive values, many exalted Indians, including journalists, will do anything to protect "their new-found social status and political clout"?

    Certainly, these revelations and their attempted suppression by mainstream media not only validate Nandy's grim diagnosis. They also confirm his suspicion that, notwithstanding the anarchist culture of WikiLeaks, the future of censorship in India is "very bright".

thoughts on journalism.....

When those news items instead of serviing the truth become apparent tools to achieve an agenda, when those bylines instead of giving a kick - give creepy feelings in the stomach.....its time to review your role.

A dog should not bite a dog but of late, a glance at newspapers from and outside Gujarat is a poor reflection of all that is going on in the State.

Myth: Journalism is crusade for truth.

Reality: Journalism is just another business at the end of the day.

And whose truth are we talking, anyways?

more than the journalists, even if we blame the managements, what about those journalists sitting on their self created pedestals who dole out prophecies in form of articles that have an agenda?

A few years ago, a Boss told me that to be a good journalist, learn to see things in black and white. I now realise that in this pursuit, running after the black and white, there is an utter disregard for the true essence of the story.

It is during such moments that, that exhilirating feeling of being an insignificant but nevertheless a part of revolutionary process dies...

Getting blind is fine but when you lose sight of purpose in journalism, the disillusionment is damning!

and our "well wishers" keep on saying, have Patience. This too shall pass!

BIG B in his blog has "wondered" why is he being hounded for promoting Gujarat. He says he will be promoting destinations in Gujarat, not the Gujarat government.

23 rd March, the day three freedom fighters of the country were hanged by the British - Bhagat Singh, RajGuru and Sukhdev. We honor them and remember them on this day. Their sacrifice for the nation was beyond imagination.

The correction on the idols of the deity in Jagganath Temple - they are changed every 12 years and apparently not buried in the earth. Thank you FmXt for the information !

So … back at the familiar address, tired but still full of energy. The flight more smooth and calm today and most of the flying hours spent in catching up on films missed out - Kameenay, Wanted, New York, Love aaj Kal and on … Revealing !! All of them, in more ways than one. I should not shy away from protocol and discuss them. But I am not sure in what spirit they will be taken. Generally whenever my name is involved, there is the obvious tendency of finding deliberate fault with it, irrespective of what the conditions or circumstances are. Guess my comments would stir up the beehive above Mayawati’s head as she addressed a public function recently. This is not an original. A cartoonist in one of the dailies did one where he addressed this very moment by stating ‘the bee hive must be the doing of the Big B’. ROTFL !!!!

It is, as another FmXt observed, more a desire to find sensational content, than wishing to address an issue or problem. What would I be doing in Gujarat that could possibly be of adverse interest to the polity, politically. I would talk of the Somnath Temple, Gandhigram,the white sands of the Rann of Kutch, old civilizations of Harrappa, the Gir lions and their extinction close by and try to entice as many visitors I could to this glorious land. Where is the connect with the glorification of the present Government ? Nothing ! But when you tickle and titillate in order to camouflage fact and detail, you do great disservice to the institutions that flourish and exist there.

Making me deliberately political, the idea is not to dissuade me from accepting the position, but indeed to get many of their facets and shortcomings an endorsement for integrity. You want to stop me from promoting tourism in a State, because you have reason to believe that there are political connotations to the event. This is such rubbish ! All I shall be doing will be the working in a short film that shall highlight the various places of interest in the State, so that it encourages more tourists to visit the region. And that is what I would precisely do when I would be asked to similar acts in Kerala. It is a petty act of cheap convenience to prevent me from doing that, and by pitting me up against political connotations and maneuvers without paying any respect for the actual work that would be done. Fair enough ! I shall abide by the judgement of the State Government. I did not ask them for it, they came forward with the invitation, I accepted, now they want to decline it, fine. Not the first time such incidents have happened. Invitation to be chief guest at the Goa International Film Festival and when I get there, they decline it. Fine !

It is a common Indian media trait - finding fault at any cost to any act or event. Merit for the moment and the work, not interesting enough to sell and so …. demerit the moment ! And in such matters if you could highlight a celebrity, preferably from the film world, into the matter, you would have discovered a way and means to keep the story rolling for a few weeks.

You take umbrage at my association with Gujarat, but never have the guts or courage to stop a Ratan Tata, or an Ambani from investing in the state and running successful factories and ventures there. Would you have the guts to tell them to not associate with the State, to pull out all their investment and man power they build through years and years of their ‘association’ ? I guess not. You would happily bring politics into the matter just to dissuade. But what good does that do to a person that is non political. Reason and common sense overrides all else in moments like this. Such a shame really. You visit a foreign country and they decorate you with respect and dignity - Morrocco, UK, USA, France, Mid East, South Africa, China Hong Kong … and you come back to your own country and they have nothing but ugliness for the subject and your merit.

Reason enough to leave this excessive topic and move towards more pleasant times !!

Tomorrow the Government of Maharashtra invites me to inaugurate the opening of the remaining four lanes of the Sea Link connecting Bandra and Worli. Time for media to start finding fault in that as well. May the lord god almighty bless you and keep you from all evil … Amen !!

Gujarat Chief Minister Narendra Modi's OPEN LETTER.

My beloved countrymen,

Namaskar,

I am constrained to write to you with a deep sense of anguish. Since last eight years, canards have been spread against me. For the past one week, if we analyse the allegations leveled against me, then the truth will become evident. Truth cannot be suppressed. It is now my duty to place before you the facts that brings out the importance of understanding what the truth really is.

After the 2002 Godhra incidents, I had categorically said in the Vidhan Sabha and in public that no one is above the Indian Constitution and the law, even if he happens to be the chief minister of a state. These are not mere words. My actions have reflected this statement in its true spirit. I assure you that this will be my stand in the future.

In spite of that, some vested interests, without losing a single opportunity and with malicious pleasure and without bothering to ascertain the truth based on mere whims and fancies, have been tarnishing the good image of Gujarat, my government and me.

Recently, there has been a systematic campaign to defame Gujarat through propagation of false reports titled 'Special Investigation Team (SIT) summons Narendra Modi'; 'Narendra Modi did not appear before SIT' and 'Modi has shown disrespect to Supreme Court and SIT'. Such baseless allegations are being leveled once again against me to defame Gujarat.

I am therefore compelled to place the facts before my countrymen.

FACTS:

As soon as newspapers began reporting that Modi has been summoned by the SIT, the government spokesperson immediately said that Shri Modi is bound by the law of the land and the Indian Constitution. He has always extended his cooperation to every procedure of law. And he is committed to do so in the future.

It is a matter of grave concern and needs investigation as to why and who started spreading lies that 'SIT summons Narendra Modi on March 21, 2010'.

The purveyors of untruth failed even to think that March 21, 2010 happens to be a Sunday and a public holiday.

These purveyors of lies even did not once bother to check whether the key SIT officers, who are appointed by the Supreme Court, were present in Gujarat on March 21, 2010.

SIT had not fixed March 21, 2010 for my appearance. To say that I was summoned on March 21 is completely false. I shall respond to the SIT fully respecting the law and keeping in view the dignity of a body appointed by the Supreme Court.

The date of 21st March 2010 was invented by some vested interest and as a part of their effort to interfere in the due process of law. They wanted to paint me as a person who refused to respond to the SIT. This country has in the last twenty four hours witnessed a campaign of disinformation in which a section of the media became an instrument of the disinformers. I hope this section will now take corrective steps.

My beloved countrymen,

The people of Gujarat and this country have identified those who are defaming Gujarat continuously since 2002. But I want to tell the truth; spreading falsehoods has only one single purpose and that is to instigate people. It is a sinful action which will harm the working of a democratic state. Seen in the backdrop of events in the last 24 hours, it shows that there is a nexus among the vested interests in spreading lies against me, in order to defame me. This machination has come unstuck and the people have seen through this charade.

The government of Gujarat has always honoured and cooperated with the investigative agencies, commissions and Supreme Court looking into Godhra and post-Godhra incidents. And that is why I never thought of giving a public statement on this issue.

Despite unbearable pain, I decided to maintain silence in the belief that the due process of law would take its own course.

But now, as the lies reach a crescendo as never before, I am compelled to bring the facts before the countrymen. I also consider it my humble duty.

I hope the truth is not twisted by the purveyors of untruth to misguide the investigation. And I expect that the media would bring my deep pain and despair to the notice of the people.

Criticise Modi and get rewarded!

It may be coincidental, but what a coincidence! A number of public figures who openly criticised Gujarat Chief Minister Narendra Modi in the recent past have been rewarded by the UPA Government, either in the form of a Padma or even a Rajya Sabha nomination.

The recent nomination of noted lyricist and screen play writer, Javed Akhtar, to the Rajya Sabha is one such coincidence. He has time and again proved his worth by scripting classics and authoring memorable songs. But equally significant has been his petition filed in the Supreme Court that put the Narendra Modi Government on the mat, by raising a stink on all encounter killings in the State.

Filed in 2007, the petition is pending in the apex court. It was the same year when Akhtar added another feather to his cap — the Padma Bhushan — in the field of literature and education. With notice issued on his petition by the Supreme Court, the petition assumed significance after the Gujarat Government was pulled up by the Supreme Court after the State police admitted its mistake in the Sohrabuddin Sheikh fake encounter killing.

With two other instances of Ishrat Jahan and Javed Sheikh alias Pragnesh Pillai also coming under the spotlight, Akhtar’s petition was separated from the bunch of petitions filed on the Godhra riots and is slated for further hearing on May 14 this year.

Akhtar’s case alone is not a coincidence. The same year when he was awarded the Padma Bhushan, the Government awarded Teesta Setalvad with Padma Shri — in recognition of her ‘fight for justice’ for Godhra riot victims. Her NGO, Citizens for Justice and Peace, was formed in response to the 2002 Gujarat carnage and her petition filed in the Supreme Court laid the foundation for reopening of riot cases, shifting of trial outside Gujarat in several cases and protection to witnesses. The apex court is seized of the petition.

Another public figure that shot to prominence with her classical dance and won recognition and several awards, is no less known for her tirade against the Modi establishment. Danseuse Mallika Sarabhai too is on the list of Padma Bhushan awardees this year. In 2009, she stood in the Lok Sabha elections as an independent candidate from Gandhinagar (Gujarat) challenging the might of BJP leader LK Advani. For Mallika, who has earlier been endowed with the Padma Shri, the recent accomplishment has come as an added privilege. It was after the Gujarat riots that Sarabhai was vocal in her criticism against Chief Minister Narendra Modi.

One other awarded personality who has found fault with Modi, accusing him of conniving with the perpetrators of the post-Godhra riots, is former Chief Justice of India VN Khare.

As Chief Justice, Khare had castigated Modi Government for failing its “raj dharma” of protecting the life and liberty of its citizens. On his retirement in 2004, Khare gave an interview to a leading national daily where he commented particularly on the State’s ‘collusion’ that he claimed forced him to react to the petitions filed by Teesta and her NGO. He was quoted as saying, “I found there was complete collusion between the accused and the prosecution in Gujarat, throwing rule of law to the winds. The Supreme Court had to step in to break the collusion to ensure protection to the victims and the witnesses.”

It was under him that the riot cases began to be monitored on a periodic basis and the Best Bakery case, where 21 accused were acquitted, got reopened. Khare was the recipient of the Padma Vibhushan, the second highest civilian award for his contribution in the field of public affairs in 2006.

A group of Dawoodi Bohra Muslim leaders today visited Gujarat Chief Minister Narendra Modi in Gandhinagar and invited him to grace the Dawoodi Bohra Chief Priest Dr. Saiyadna Saheb’s 99th Birth day celebration function as a Chief Guest. A grand birth day celebration function of Saiyadna Saheb will be held on 4th April 2010.

The Bohras thanked Gujarat Chief Minister for appointment of one of the leading community members Rukaiyaben Gulam Husainwala as BJP’s Panchamahal district national council member.

Sheikh Imranbhai, Abbasbhai, Dr. Nuruddin were part of the delegation among others.

Adani Power disqualified in GUVNL bid.

Gujarat based Adani power has been disqualified in a b id to provide long term power supply . Adani Power Limited(APL) had bid for 2200 MW in a bid floated by Gujarat Urja Vikas Nigam Ltd (GUVNL) .

"We have disqualified APL at technical stage because the their bid was not responsive to the stipulated conditions of the bid," Mr L Chuaungo, MD GUVNL said.

APL has been disqualified because it failed to provide details for fuel linkage tie up to generate power to be supplied to the state owned entity.

In response to GUVNL's offer inviting bids for supply of 3000 MW power on long term basis, as many as 11 companies engaged in power sector, had bid for aggregated 6800 MW power.

Among the 11 companies, APL had offered the highest power of 2200 while Essar power has offered 800 MW and KSK energy's subsidiary Vardha Power has bif for 1000 MW power.

Now, minus Adani, 10 companies are in the race and financial bids of these companies are likely to be opened this week.

" Adani Power had expressed its interests for long term power supply generated from indigenous coal. However, it failed to ensure any tie-ups for fuel supplies to its proposed plants", top sources said.

According to the sources close to the development, Adani Power has applied for coal linkage with the coal companies but it has not received any assurance from them.

Just recently, APL has given a notice to the Gujarat government terminating a long-term power purchase agreement (PPA) inked in 2007 for supply of 1,000 MW for 25 years. Adani’s decision to scrap the PPA has evoked a controversy with GUVNL challenging Adani’s decision.

The PPA was signed following a competitive bidding and Adani group had committed to supply power at Rs 2.35 per unit for 25 years. Since market rate of power has shot up, Adani opted to scrap the PPA.

Subsequently, GUVNL has challenged the APL's notice before Gujarat Electricity Regulatory Commission (GERC) which will take a final decision on the issue after conducting hearing of parties involved.

Former chief secretary and current chairman of sardar sarovar nigam D Rajgopalan is not a happy man. He is upset for being dropped as chairman of the blue chip baby of the Modi government, the Gujarat State Petroleum Corporation(GSPC).
Yesterday the State govt in a surprised move replaced mr rajgopalan with chief sec A K Joti. Mr Joti will now spearhead the GSPCs proposed and keenly awaited IPO. After he retired as CS, it appeared the Govt was in a mood to continue him at the helm of affairs at the GSPC but the govt sprang a surprise which has shocked, angered and upset Mr Rajgopalan.

P Paneervel to stay back in Gujarat only.

P paneervel, principal secretary revenue who was all set to leave for deputation in Delhi has had a last minute change of mind and change of plans.
His name now stands withdrawn so he will continue to serve Gujarat.
MR Paneervel's name was doing rounds for quite a few lucrative postings like chairman JNPT, establishment officer in the DOPT and a plum posting at the ministry of commerce.

Sujit Gulati Delhi bound.

85 batch officer and currently development commissioner of the State Mr Sujit Gulati will be going on a deputation to the Centre. He is likely to join the Ministry of Home affairs as joint secretary.

In the ministry, there will be two Gujarat cadre officer. O Ravi and Sujit Gulati.While Mr Ashim Khurana who is also a joint secretary in the MHA is returning, Mr Gulati is likely to go to the same ministry.

J N Singh was one of the most trusted lieutanants of former chief minister Shankarsinh Vaghela also who later took him to Delhi when he became union textiles minister. J N is about to complete his five year stint but is apprhensive that he might not get a good posting in Gujarat in the Narendra Modi regime. The grapevine tells us that a Gujarat based industrialist with interests in infrastructure, port and power is helping him earnestly.
This industrialist in the past also has "hel-ped" quite a few babus who are now more loyal to him than the position they hold on to.

On January 22, 2010, the GSPC Pipavav Power Company Limited (GPPC-a subsidiary of the Gujrat State Petroleum Corporation , under the control of the Energy and Petrochemicals Department of the Government of Gujrat-) issued a press release notifying what it called the “First Carbon Credits’ Linked equity investment finalized in a unique public –private partnership for power projects in Gujrat.

The brief particulars provided in the press note confirmed that a company by the name Swan Energy Limited (SEL) would get 49% equity and become the single biggest shareholder in the GSPC Pipavav Power Project (GPPC) while the current owner of the project , GSPC-GUJRAT STATE PETROLEUM CO- would reduce its holding to 34% and GPCL would hold 17% of the equity. SEL would pay Rs 381 crores for acquiring the 49% equity. In addition SEL would get 70% of the carbon credits expected to accrue to the project.

The 702mw gas based Pipavav power project of GPPC is under execution and is to be commissioned in December 2010 and has approvals to expand its capacity to 1050 Mw. The project is likely to receive carbon credits to the tune of 1.2 million units annually for its capacity currently under execution.

A simultaneous press note issued by the company –SEL – runs along the same lines but adds that the company is in the process of developing a floating Lng terminal at Pipavav and that the state government have given approval to GPPC to convert three existing coal and FO based plants to gas based power plants and that these would generate about 10 million units of carbon credits per year when implemented.

The press notes attempt to create the impression that a great strategic alliance is being formed between two great industrial giants taking Gujrat to unexplored new heights in some unique financing of public sector projects. Among the high sounding words what lies buried is the avarice and the most brazen, unthinkable and wicked conspiracy hatched at the highest levels of the Gujrat state government to defraud the state and the public of Gujrat , with brow beating, compromising and subversion of the state’s bureaucracy and the ingenious way of executing it so that it cannot be detected but with great effort.

To begin with Swan energy is not a company involved in the energy sector but has a nominal presence in the textile business and land deals.

A look at the annul results of this company (SEL) available on the net shows that it has suffered operating losses from 2005 to 2008, has no material consumption in 2008 and 2007 and has material consumption of less than an average of Rs 1 crore in 2005, 2006 and 2005, reports no payment of salaries and wages in the years 2005, 2006, 2007 and 2008 while has a modest out go of Rs 12 lakhs in 2009, has not paid any excise duties from 2005 onwards but has huge ‘other expenses’. All these indicate that the financial records of the company are nothing but forgeries and made up.

The company has only a capital base of Rs.19 crores and calims only a cash balance of Rs.57 crores at the end of the last financial year.

In effect,it does not have the capacity to pay for the 49% equity of the GPPC and need to raise funds purely on the basis of the windfall it expects form the largesse the Government of Gujrat has now bestowed on it through the virtual grant of free equity in one of its blue chip companies and the huge recurring and undeserved income it gets through the unwarranted grant of 70% of the carbon credits accruing to GPPC.

SEL has no back ground in engineering, much less in power generation or project planning and execution or its profitable management. The key functionaries of the company are Dalals and deal fixers and their only claim to any distinction is the proximity to the most important state functionary of Gujrat today which they have used to intimidate, cajole and induce the lower functionaries, on the verge of retirement and others to participate in this dastardly and heinous ,rapacious loot of public wealth. Their credentials to be given such a huge chunk of the equity of GPPC is no better than that of any fixers who throng the corridors of the Gandhinagr Sachivalaya or of any Pan Galla operator or vegetable vendor of Gandhinagr who do a much better management of legitimate business.

The power project of GPPC is nearing completion and according to the claim made in the press note it is to be commissioned in Dec 2010. This means the technology was finalized long ago, loans tied up, financial closure achieved, environmental clearance obtained, fuel linkage established and long term power sale agreement executed with buyers.. There is nothing regarding the project to which SEL would provide any inputs, even assuming it had the expertise for it. Even the entitlement for carbon credits it intrinsic to the technology and the fuel used and is not dependant on the participation or contribution of SEL. Hence inviting SEL to the equity of GPPC is simply a devious and dastardly and most dishonest means of transferring public wealth for private benefit, this being the latest of a series of such measures which the energy department under the control of the chief minister has perfected into a consummate art form, in the last five years or so with the help of a set of pliant and dishonest officials..

There are three major factors which go to establish that the introduction of SEL as an equity holder of GPPC is a scam of unprecedented proportions.. They are the departure from established procedures for divestment of equity in undertakings of the Government, the abnormally low price at which equity is being transferred and the transfer of other monetary benefits without any consideration through assignment of 70% of carbon credits accruing to the project to SEL.

A number of companies in the process of establishing power projects have gone for diluting their equity in the recent past. Reliance power offered their 10 rupee share at a premium of more than 250 rupees( after the issue of bonus shares) KSK
energy ventures sold their 10 rupees shares at a premium of 240 rupees. Those who entered the capital market, when the economic scene was the grimmest, namely ADANI POWER AND Jindal power sold their 10 rupee share at a premium of Rs 100 each or thereabouts.
As on 04-02-2010 a ten rupee share of Tata power was trading at about 1290 rupees, while the Reliance and KSK shares were trading at respectively Rupees 146 and Rs.177. The erstwhile owner of GPPC, GSPC offloaded 5% of its equity through private placement each Rs 10 share being sold at Rs 800.

If the public issue or the private placement route was adapted in the case of GPPC, its’ 10 rupee share could have been sold at a premium of at least Rs 250. The press note issued by GPPC and SEL does not mention the premium at which shares were sold to SEL . But having regard to the total amount to be paid for the 49% equity and the total equity of GPPC it appears that only a insignificant premium of 27 rupees were charged and the shortfall is Rs. 223 per 10 rupee share and the total shortfall is RS 2296.29 Crores.

At 49% SEL would be the single largest share holder of GPPC The 17% share holder, GPCL(Gujrat State Power Corporation ) is to be wound up and in that eventuality it will be a cake walk for SEL to gain majority stake in the company by another sleigh of hand and devious transaction similar to the one through which it has now gained entry into GPPC .
The loss of 2296.29 crores to the government company is the gain to SEL, which it has obtained at the cost of pandering to the pecuniary interest of the politicians and bureaucracy who took the decision in favour of the deal.


The loss above calculated does not take into account the potential premium the company could have charged for the virtual management control being handed over to SEL in terms of the huge holding of 49% equity in the company.

According to the press note issued by SEL the three projects for the conversion of the thermal power stations to gas based power stations would generate 10 million units of carbon credits. According to the press note of GPPC and SEL the Pipavav project at its currently planned capacity will generate 1.2 million units of carbon credits. When the capacity is enhanced form 702 MW to 1050MW the entitlement of carbon credit from the Pipavav project would increase proportionately to 2.3 million units. The total units of carbon credit available to GPPC would be 13.2 million units. CERs, like shares and derivatives are tradable and have a ready market in the exchanges specially dealing in these like stock markets.

In this curious and atrocious deal SEL has been given the rights for 70% of the CERs ie the rights for 9.24 million CERS . Each CER has a current value of some 20 EUROS. The current conversion rate between EURO and Rupee is 1:65. The economic value of the ECR entitlements signed away to SEL by this unique deal is 9.24 multiplied by 20 multiplied by 65 million rupees. It comes to a staggering Rs. 1200 crores per year and for the ten year period for which according to the press notes, ECRs would be available to the project, a whopping Rs 12000 Crores, all for an investment of 381 crores. To get an income of Rs 1200 crores per year , SEL should have , at the current bank rates invested at least 12 times that amount, namely Rs 14400 Crores.
It means SEL got 49% of GPP not only free of cost but has been blessed with a huge annual pay out. The total loss to the state exchequer is thus is about Rs 14300 crores. (1200*10)+2296 crores .What can be more vibrant than this in Vibrant Gujrat.

Only a fool will think that this was given free of cost or for a senior functionary of SEL suffering a long flight to Moscow on a winter night in the company of Narendra Modi or for suffering the inconvenience of attending the marriage of the daughter of a just retired bureaucrat in far away Chennai with the unavoidable difficulty of accommodating his copious frame in an impossibly narrow single aircraft seat.. It is more likely that the Modis , Saurabh Dalals, Kailasnathans, Rajgopalans, Jagatheesa Pandians ,Jagadeesans , Tapan Rays,Jyothis and Srivastavas and their ilk have more than elementary education and the ability to have understood these numbers and would not have done this huge atrocity without some stake in the deal.

It is precisely the huge benefits that the deal makers wanted to bestow on SEL that the divestment of equity in GPPL was done as a hush hush affair against established practices applicable to public sector undertakings. If the government wanted to do any such thing it should have been done in a transparent manner and at a price at which the market would pay for the acquisition of the equity.

The energy department and GSPC in particular just like it’s more celebrated sister concern GUVNL, has a long history of picking up dubious characters and making them billionaires overnight. All deals are kept under wraps. No information is provided even under the rights of information act. Chosen officers who are plaint and capable of complicity are kept in strategic positions for inordinately long periods, threatened, cajoled and induced by various methods to commit illegal acts and then to defend.

Only few know that a sizeable portion of the profits accruing to the state and GSPC form its gas fields in the KG basin has been signed away to a foreigner, a once low paid employee of a company called Niko resources and another company of which no one had heard till then. More on these later when full details are available.

If there is any thing unique about this deal, it is the speed, brazenness and magnitude of the loot of public money involved in this.

Unfortunately this state has no mechanism to deal with misdeeds of the political executive and the vigilance commission itself is interested only in catching the small fish and shy away from looking at such monstrous deeds as is evidenced by the levity with which it ignored another serious complaint about a mega scam in the GUVNL on the specious plea that the matter is before the courts when in fact it was the court which exposed the staggering loss to the exchequer and nothing further was pending in the court.

May be it is high time for the highest judicial forum judiciary to order an inquiry under its supervision through the CBI, into this deal and equally notorious and suspicious deals in the various entities under the control of the energy department of Gujrat during the last 5 years at least.

Shivraj Chouhan takes a dig at Narendra Modi, Jaitley...


NEW DELHI: Madhya Pradesh chief minister Shivraj Singh Chouhan on Friday triggered a fresh controversy when he asked politicians to stay away
from sports associations.

Mr Chouhan’s remarks, made during the course of a press conference here on Friday, were seen by political observers as yet another manifestation of the factional infighting that has gripped BJP in the past few years. Several senior party leaders man important positions in various sporting bodies, and the Madhya Pradesh chief minister’s utterances were seen as being directed at them.

BJP Rajya Sabha leader Arun Jaitley heads the Delhi District Cricket Association (DDCA) and Gujarat chief minister Narendra Modi is the boss of the Gujarat Cricket Association. Hamirpur MP Anurag Singh Thakur presides over the Himachal Pradesh Cricket Association and opposition leader of Delhi Vijay Kumar Malhotra is the senior vice-president of the Indian Olympic Association and president of the Archery Association of India.

``I feel that political leaders should stay away from sports associations,’’ the Madhya Pradesh chief minister told newspersons after meeting sports and youth affairs minister M S Gill to take up cudgels on behalf of the Indian hockey players, who have been agitating for better working conditions.

Mr Chouhan sought to come to the aid of the hockey players, particularly the members of the women’s team, by offering Rs one crore. His attempts to present a cheque of that amount to the sports ministers could not succeed as the latter could not specify the name of the person or the body after whom it was to be made out.

When it was pointed out to him that several of his party colleagues were leading important sporting bodies, Mr Chouhan said he was taking any names, but was only making a `general’ suggestion. ``There is more politics setting into sports, rather than sports influencing the course of politics,’’ he contended. He also expresses his disgust over the way hockey was being managed in the country, asserting that Indian hockey had become `a joke.’

This is not the first time that Mr Chouhan has entered into competitive politics with his party colleagues. Earlier this month, he had raised several eyebrows when came out in the open against the Gujarat government’s move to implement compulsory voting in elections to local bodies. He argued that the political class should discharge their responsibilities dutifully to ensure that the faith of the poor in the political class grows stronger, thereby encouraging them to vote in large numbers.

The Gujarat chief minister was the target of his Madhya Pradesh counterpart’s diatribe on Friday also, leading party leaders to wonder whether there was another personality clash building up here.

ADANI LETHARGY IN COAL EXPLORATION AT MORGA II


Ahmedabad, Jan 22:

Hyderabad based KSK energy which has agreement with State owned Gujarat Mineral Development Corporation(GMDC) for supply of coal for its 1750 MW power plant at Chhatisgarh has written to Gujarat Government drawing attention that GMDC is going slow to start mining at Morga II coal block . It has drawn the attention that GMDC had promised it would begin the development of the coal block but however was going at a very slow pace which was resulting in financial loss to KSK.

The letter written by KSK gains significance because it is being openly alleged that GMDC has been deliberately going slow at the behest of a Gujarat based industrial house. The official KSK communiqué points out that GMDC has given Adani Enterprsises the job of exploration at Morga II block from where coal is to be supplied for the power plant. Interestingly, KSK and Adani are competitors in the energy sector.

GMDC awarded coal exploration contract to Adani enterprises in October 2009 but no work has yet commenced. K Kishore, director of KSK has written to industries and mines secretary Maheshwar Sahu in Gujarat requesting that GMDC be asked to present a plan as to how they wish to comply with the development milestones.

“we have endeavoured to keep all our commitments to GMDC and we are on schedule in our power project and cannot afford any delay in receipt of coal from Morga”, Mr S Kishore has written in his letter.

KSK cannot bid for power supply to Gujarat if coal exploration does not begin. KSK has offered to supply power to Gujarat at 1.98 rs per unit. This delay could benefit Adani who would then supply power at a higher rate to Gujarat. Earlier the Gujarat High Court also pulled up the Gujarat government for favouring Adani and buying power at higher cost and weeding out other competitors who were ready to supply power at same rate or in some cases even at rates lower than Adanis.

In 2008, Gujarat government purchased power on short term basis worth Rs 670 crore out of which 437 crore of power was purchased from Adani Enterprises. Adani enterprise sold power at a whopping rate of Rs 6.48 paise per unit.

However, in the letter sent to Gujarat government whose copy is with this newspaper, Mr S Kishore has pointed out that KSK has achieved financial closure for its entire 3600 MW power project to be set up in Chhatisgarh.. KSK has informed gujarat government that it so keen to commence plant at the earliest that it has already made necessary capital arrangements to fund the project execution. KSK has said for this ambitious 16,1`90 crore project, they have raised 4,048 crore from the market through its IPO and tied up with a variety of banking and financial institutions and have managed to get Rs 12,142 crore.

KSK has already placed equipment purchase order for its power plant but sadly till coal exploration commences, it is helpless.

KSK has written to Gujarat government, “our financial leaders have expressed their concern at the slow paced development of Morga II coal block. Failure of GMDC would result in huge financial loss for our company. “KSK has requested a joint meeting of GMDC and Gujarat government officials to sort out the issue.

Geetha Johri does not want to be a part of SIT anymore...


Senior IPS officer Geetha Johri has written to SIT chairman R K Raghavan and drawn the attention of the amicus curiae of SC Harish Salve regarding “allegations” made against her in the Supreme Court. Ms Johri has categorically requested that she be dropped from the high powered Special Investigation Team (SIT)appointed on instructions of the Supreme Court toinvestigate select cases of large-scale violence and massacres that took place in Gujarat in the aftermath of the 2002 communal riots. The SIT is also probing the role of Gujarat Chief Minister Narendra Modi in Gujarat riots.

Ms Johri confirmed that she does not want to be a part of the SIT in view of the recent Supreme Court observations where allegations were made about the way she had conducted investigations in the Sohrabuddin Fake encounter case. The investigation of this case has now been handed over to the CBI.

On Tuesday, solicitor general of India ,Gopal Subramanian , during hearing in the Supreme Court on the SIT, sought reconstitution of the SIT . He submitted the team should be reconstituted because the Apex Court has passed sever remarks against one of the members ( Ms Johri) in the Sohrabuddin encounter case, which has now been given to CBI for investigation. Interestingly, the Court has accepted the submission and posted the matter for further hearing on February 9.

Ms Johri has drawn the attention of Mr Salve regarding allegations made against her. She believes that her integrity and objectivity is constantly being questioned,” a senior official of Gujarat government told this paper.

While ordering the CBI probe in the sensational encounter case in which Sohrabuddin, his wife Kauser Bi and an informer Tulsiram Prajapati were killed by the Gujarat police, the Supreme Court bench of Justices Tarun Chaterjee and Aftam Alam remarked that the Gujarat police did not investigate the case in proper manner and has left many discrepancies .

"Mr V L Solanki, an investigating officer, was proceeding in the right direction, but Ms Johri had not been carrying out the investigation in the right manner, in view of our discussions made herein above. "It appears that Ms Johri had not made any reference to the second report of Solanki, and that though his first report was attached with one of her reports, the same was not forwarded to this Court. Therefore, we are of the view that her mentioning the criminal background of Sohrabuddin and the discussion among the accused officers concerning Sohrabuddin was meant to obfuscate the enquiry," the apex court said.

The court lamented that the Gujarat Government deliberately attempted to mislead the court on the whereabouts of Sohrabuddin's wife Kauserbi and their family friend Tulsiram Prajapati who are also alleged to have been killed by police to destroy evidence.

The SIT headed by former CBI chief R K Raghavan was constituted under the directives of the Supreme Court last year in April to probe the complaint of Zakia Jafri, widow of former Congress Rajyasabha MP Ehsan Jafri . Ehsan Jafri was one of the hundreds who was burnt to death in his Gulberg socity residence in the aftermath of Godhra riots. Ms Jafri has been pointing towards the alleged role of Modi and other senior politicians in the 2002 communal riots. The nine cases SIT is investigating include incidents of Gulberg Society, Naroda Gaon, Naroda Patiya and Sardarpura.

Urmilaben is the mother of present Gujarat Cong president Sidharth Patel.
A woman of substance, she assisted her husband late Chimanbhai Patel and made her foray in politics while he was alive.

Dr. Urmilaben Patel(Phd)’s political career came into limelight when she contested an election of Jamnagar Lok Sabha seat in 1991 which she lost to BJP.

Urmilaben was nominated from the Rajyasabha. She then became(10 February 1995) a Minister of State for Power in P.V.Narsimharao’s ministry. Patel was not re-elected to Rajya Sabha after her term ended, but was given a ticket to contest Vadodara Lok Sabha seat in 1999. However she was again defeated by rival BJP candidate, this time – Jayaben Thakkar. Urmilaben was also a Special Invitee in Congress Working Committee after 90s.

For last several years, she was associated with several NGOs. Her son Siddharth Patel, MLA of Dabhoi assembly constituency became Gujarat Congress President in July 2008.
